殘疾慢性病申請社險養老金‧未滿60可再索賠

2012年社險（修正）法令今年生效後，那些曾經因為年逾55歲向社險機構索償傷殘疾病退休養老金而被拒絕的人士，若未滿60歲，可以再次向社險提出索償。

曾佛清接受星洲日報專訪時，為那些因失去工作能力曾經申請養老金被拒的人士捎來好消息。

在法令通過前，申請傷殘疾病退休養老金（Pencen Ilat）的年齡必須在55歲以下，或須證明有關殘疾是在55歲之前發生，並且從那時起已無法工作。倘若已超過55歲，或是在申請期間繼續工作，有關申請一律不被考慮。

他指出，上述養老金提供的保障包括與工作無關的殘疾及慢性病，如心臟病、腎病、癌症、慢性哮喘、中風等。

這項養老金將在社險機構收到殘疾通知或僱主提呈傷殘疾病通知後的停止工作之日起計算。一旦獲批，僱員可享有相等於工資50至65%的養老金，最低額為每月475令吉。

殘疾慢性病可享養老金

僱員可一直享有這項退休金直到康復；如果僱員在接受傷殘疾病養老金時去世（不計年齡），養老金將轉換為遺囑撫恤金（Pencen Penakat），可繼續支付給配偶，直到配偶去世為止。

如果有關僱員沒有配偶，卻有未滿21歲的孩子，他的孩子也可獲得有關撫恤金，直到21歲為止。若超過一名孩子，他們將平分有關撫恤金。

首天上班就受保
上下班途中意外獲賠

按法令定義，凡在服務合約下受僱於某一僱主或當學徒者皆屬於僱員。無論這名僱員是暫時性抑或是尚未過試用期，都得向社險機構呈報。

受聘的僱員第一天來上班，就算還未進入公司打卡，但法律上已經是一名員工了。倘若他在上班途中發生意外，將可向社險機構提出申請索取賠償。

如果公司沒有為員工登記為受保者，一旦發生意外，社險會先聯絡有關僱主，追查僱員的受聘合約。僱員若符合資格便必須受保，社險機構將先開罰單給雇主，若雇主屢勸不聽便會被被控上法庭。一旦公司辦妥手續，僱員可向社險機構索取工傷賠償，但手續耗時較久。

繳費月超過就職月三分一
失業停繳仍受保

許多人誤以為一旦沒有工作，就不受社險所保障，這是不確實的。

社險機構執行部福利組行政官李國華指出，只要符合社險機構的資格規定，皆可申請。

他舉例，某人辭職後已停止繳交社險，但是只要從加入社險到申請社險福利為止，有繳費的月份超過就職月份總數的三分之一，而繳交社險月份的總數不少於24個月，便符合資格申請殘疾退休養老金。

他補充，一些僱員因轉換工作，斷保數個月後又續保，但只要繳納保費的月份總數超過三分之一個月，同樣可以受惠。

李國華從以下的例子，說明了一名僱員即使間中沒有工作而停繳社險，仍符合申請條件。

社險分2配套
55歲無法享殘疾退休金

曾佛清指出，社險分為2種配套，第一類適用於55歲以下的僱員，僱主和僱員同時為工傷保險計劃和殘疾退休津貼計劃繳納保費。

第二類適用於55歲以上仍繼續工作的僱員、第一次向社險機構注冊且繳納保費時已過50歲的僱員以及領取殘疾退休津貼同時繼續工作而收入低於殘疾前收入三分之一的受保人，僱主只為上述群體繳納僱主份額的工作工傷保險計劃保費。

他補充，這也意味著投保第二類者，已無法享受殘疾退休養老金的福利。

此外，他指出，不能受保者包括政府公務員、自由工作者、家庭傭人、外國工人、獨資或合資經營的業主及其配偶。

申請次數無限
不諳國語可求助華裔官員

社險的申請次數不限，若申請失敗，還可以在更新資料後重新申請。但若申請者認為自己的個案情有可原，但仍被駁回，申請者還可以向社險機構上訴局提出上訴。

李國華解釋，上訴局擁有如地庭般的權力，因此若申請者上訴得直，則社險機構必會遵守賠償；反之，申請者若失敗了，還是能向高庭上訴。

可自行辯護

“不需要請律師，可以自行辯護，而且只需繳付2令吉的印花稅即可。＂

此外，李國華也提醒公眾切勿依賴中間人幫助申請，只要親自到社險機構辦事處，所有服務都是免費的。

“就算不會馬來文，服務人員也會儘量找來華裔官員幫助解答，並協助填寫表格。＂

他指出，這些中間人懂得社險的作業方式，因此訛稱自己“有門路＂幫忙，藉此收取高額費用。但事實上，不只所有表格和申請服務都是免費，而且更有明文規定社險機構職員必須為受保者提供免費援助。

加班公傷可獲賠
依醫藥報告警方途徑查真相

工傷保險計劃保障了受保者在執行工作時發生意外、在值勤路途中發生意外及在工作場合發生的緊急事件及職業導致的疾病。

就算當時已超過了正常工作時間，包括超時工作或假期突然傳召回公司，或是所做的事不在一般工作範圍內，包括外出午餐等情況，但只要是因公事受傷，便可獲賠償。

但是，若有人在值勤路途中，沒有依照正常的路線前往目的地，即繞道探望朋友或是處理私事，則不獲賠償。

“比如你在八打靈再也工作，但是卻到巴生吃午餐，這便不合邏輯了。但若因塞車或是為了添油而繞道，這便情有可原。

“若是投票日當天必須工作，則投票是公司授權的行為，因此投票前後發生意外也包括在內；但若是投票日當天請假，則不獲賠償。

工商保險計劃明文規定，與工作無關的皆不獲賠償。社險機構職員可從醫藥報告、警方報告等許多途徑查出真相。

無論如何，受保者必須報案，口供以警方的報案書為准。

未註冊可呈請柬證明
李國華：配偶可獲賠償金

至於夫妻未註冊，配偶是否能獲得賠償金的問題，根據婚姻註冊法令，1982年3月1日前的夫婦，只要曾經以任何一種形式結婚，便算是正式夫婦。但在1982年後結婚的夫婦，便必須註冊才能算是合法夫妻。

李國華建議，沒有一紙婚書的夫婦可以出示請柬、結婚照等物品，證明曾結婚。

雖然如此，孩子則不受限，就算是非婚生子，孩子也受到保障，但婚姻註冊法通過後，所有初生嬰兒都必須登記，因此鮮有出現非婚生子女的情況。
